Why would I need an attorney to write a lease?

The Florida Supreme Court has stated that unless you are either the property owner or the tenant then preparing a lease is the unlicensed practice of law, which is a third degree felony. If you are not the property owner or the tenant then you can use the Florida Supreme Court approved form lease, but you cannot make any modifications to lease, cannot draft any addendums and this form lease comes with the following disclaimer: “Neither the Supreme Court of Florida nor The Florida Bar express an opinion as to whether the forms comport with current law.” A lease is a legally binding contract between two parties that conveys great rights and responsibilities. With the complexities and constantly changing laws relating to the leasing of property it only makes sense use an attorney to draft your leases.

When can I submit my lease for drafting?

How long does the lease drafting process take?

That is up to you! When you submit a lease request we ask you when you need it by and our goal is to always meet or beat your deadline, even if you need the lease the same day.

When can I get the status of my lease?

You can login to your account anytime, 24 hours a day, 7 days a week to review the real time status of your lease. If it is not convenient to login, that is okay, because the real time status of your lease will be emailed to you at every step of the drafting process.

After I submit a lease request can I cancel it?

Yes you can. However, our goal is to process your lease as quickly as possible. Often we will begin drafting your lease within hours or even minutes of your request being submitted. Of course, if you contact us to cancel your lease prior to drafting we will issue a full refund.

What happens if the tenant decides not to lease a property after the lease is drafted?

If the tenant does not go forward with leasing a property after the lease is drafted then your account will be credited the entire fee, which will be applied to the next lease on that property.

Do I need an attorney to file an eviction?

No, not necessarily. If you are the Property Owner you can certainly file the eviction on your own and represent yourself in the lawsuit. If you are the Property Manager you can file the eviction on your owner’s behalf with some limitations. With the written permission of the Owner, a Property Manager can file an eviction based on the non-payment of rent only if a money judgment against the Tenant is not being sought and the Tenant defaults. If the Tenant contests the eviction a lawyer will need to be retained to finish the eviction. When can I submit my eviction for processing?

On Eviction 24/7 you can submit your evictions for processing anytime, 24 hours a day, 7 days a week! Once submitted your eviction will be reviewed for accuracy and filed with the Court within 24 hours of the next business day.

How long does an eviction take?

The time it takes from the filing of an eviction to getting your property back from the Tenant can vary quite a bit due to factors that are not in our control such as: the Judge; the Clerk of the Court; the Sheriff’s Department; and most importantly the Tenant. However, if the Tenant does not contest the eviction then your property can be returned to you in about 30 days.

When can I get the status of my eviction?

You can login to your account anytime, 24 hours a day, 7 days a week to review the real time status of your eviction. If it is not convenient to login, that is okay, because the real time status of your eviction will be emailed to you at every step of the eviction process.

What is a “Writ of Possession” and do I really need it?

The Writ of Possession and its service by the Sheriff on the tenant is what actual gives you back your property, so yes, you really need it. After you get a final judgment of eviction the Clerk of the Court will enter the Writ, which tells the Sheriff to serve the Writ on the tenant by posting it on the door of the property. 24 hours after the Sheriff serves the Writ, only then can you lawfully retake possession of your property. In addition, if the tenant does not move out after service of the Writ the Sheriff is allowed to physically remove the tenant from the property and keep the peace while you remove the tenant’s belongings.

After I start an eviction can I cancel it?

Yes you can. However, our goal is to process your eviction as quickly as possible, so no later than 24 hours after you submit your eviction it will be filed with the Court. Often your eviction will be filed within hours or even minutes of it being submitted. Keep in mind that the Courts will NOT issue refunds for any filing costs and the flat attorney fee we charge is non-refundable. Of course, if you contact us to cancel your eviction prior to filing we will issue a full refund.
