CORONAVIRUS (COVID-19) INFORMATION

Updated September 4, 2020 ‐The executive order entered on August 8, 2020 by President Trump regarding residential evictions is not an extension of the Federal CARES Act and does not prevent proceeding with residential evictions at this time. Florida Governor Ron DeSantis executive order providing the Tenant a defense of being adversely affected by Covid-19 for residential non-payment evictions was extended until October 1, 2020. Effective September 4, 2020 the Centers for Disease Control (CDC) issued an agency order that will operate as a moratorium on some non-payment evictions throughout the United States. For those Tenants who meet the various criteria under the CDC Order, then any eviction proceeding for non-payment of rent is subject to being stopped upon the Tenant submitting an affidavit to the Court. The CDC Order does not affect other types of evictions (ie: holdovers, 7 Day Notice violations, etc.) or unlawful detainer actions.

We are continuing to file residential non-payment evictions and prosecuting them in compliance with these various executive and agency orders. For properties with federally backed mortgages (FHA, VA, etc.) or that receive subsidized rent (Section 8, etc.), we are also filing residential non-payment evictions after the posting of a 30 Day Notices to Pay or Vacate. Evictions for any basis other than non-payment of rent that do not have federally backed mortgages (FHA, VA, etc.) or receive subsidized rent (Section 8, etc.) can be filed with no restrictions.
